RE: The tariff classification of socks from China.

Dear Ms. Rowe:

In your letter dated April 1, 2015, you requested a tariff classification ruling.

Styles SW800, SW801, SW811 are men’s knit crew socks which you state are constructed of 49% cotton, 48% nylon, and 3% spandex.

Style SW802 is a men’s knit crew sock which you state is constructed of 56% cotton, 41% nylon, and 3% spandex.

Styles SW803, SW 804 and SW805 are men’s knit crew socks which you state are constructed of 50% nylon, 47% cotton and 3% spandex.

Styles SW806, SW807 and SW812 are men’s knit crew socks which you state are constructed of 52% cotton, 45% nylon, and 3% spandex.

Styles SW808, SW809 and SW810 are men’s knit crew socks which you state are constructed of 51% cotton, 47% nylon, and 2% spandex.

Styles SW813, SW814 and SW815 are men’s knit crew socks which you are state are constructed of 57% cotton, 40% nylon, and 3% spandex.

For the purposes of this ruling, we will assume these measurements to be correct. However, the accuracy of these component weight breakdown figures will be subject to verification at the time of actual importation by Customs and Border Protection at the ports of entry.

The applicable subheading for styles SW802, SW806, SW807, SW812, SW808, SW809, SW810, SW813, SW814, and SW815 will be 6115.95.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pantyhose, tights, stockings, socks and other hosiery, including stockings for varicose veins, and footwear without applied soles, knitted or crocheted, other, of cotton, other. The rate of duty will be 13.5%.

The applicable subheading for styles SW800, SW801, SW811, SW803, SW 804, and SW805 will be 6115.96.9020, HTSUS, which provides for panty hose, tights, stockings, socks and other hosiery, including stockings for varicose veins, and footwear without applied soles, knitted or crocheted: Other: Of synthetic fibers: Other: Other…Other. The duty rate will be 14.6% ad valorem.

For all future requests, limit your ruling request to a maximum of 5 merchandise items, all of which must be of the same class or kind.
